Welcome to Creative Lab. These Terms & Conditions govern your use of the Creative Lab website and your purchase or use of our creative, design, development, branding, video editing, and other digital services.
By accessing our website, submitting an inquiry, placing an order, making a payment, or engaging Creative Lab for services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. If you do not agree with these terms, please do not use our website or services.
Creative Lab provides digital creative services for creators, streamers, gaming communities, businesses, and other clients worldwide. Our services may include logo design, banners, static and animated overlays, emotes, stream packages, video editing, website development, landing pages, e-commerce stores, graphic design, branding, game development, and related digital services.
The specific services, deliverables, pricing, timelines, and requirements for each project may vary depending on the package or custom agreement selected by the client.
By using our website or purchasing our services, you confirm that:
• You are legally capable of entering into an agreement.
• The information you provide to Creative Lab is accurate and complete.
• You will use our services and delivered materials for lawful purposes.
• You have the necessary rights and permissions to provide any content, images, logos, videos, text, trademarks, or other materials supplied to us for use in your project.
If you are purchasing services on behalf of a company, organization, or another person, you confirm that you have the authority to accept these Terms & Conditions on their behalf.
ORDERS AND PROJECT REQUIREMENTS
Before beginning a project, Creative Lab may require information, references, content, brand guidelines, dimensions, specifications, or other materials from the client.
The client is responsible for providing accurate project requirements and all necessary materials in a timely manner.
Creative Lab is not responsible for delays caused by incomplete information, late responses, changes in requirements, or other circumstances outside our reasonable control.
A project may be considered officially confirmed once the client has accepted the relevant quotation, package, proposal, invoice, or project agreement and any required initial payment has been received.
Custom projects may differ from the standard packages displayed on our website.
For custom orders, Creative Lab may provide a separate quotation or project proposal describing the scope of work, deliverables, estimated timeline, revisions, and applicable fees.
Any work requested outside the agreed scope may require an additional fee and may result in a revised delivery schedule.
All prices are based on the scope of work agreed upon with the client.
Creative Lab may require a deposit, partial payment, or full payment before work begins, depending on the project or package.
Payments must be made using the payment method or instructions provided by Creative Lab.
The client is responsible for providing correct payment information and completing payments when due.
Creative Lab reserves the right to pause work or withhold delivery of final files if an applicable payment remains outstanding.
Any taxes, transaction fees, currency-conversion charges, or payment-provider charges applicable to the client’s transaction may be the responsibility of the client unless otherwise agreed.
Creative Lab will make reasonable efforts to complete projects within the estimated timeframe communicated to the client.
Estimated delivery times are not guaranteed unless a specific deadline has been expressly agreed upon in writing.
Project timelines may be affected by:
• Delayed client feedback
• Missing project information
• Additional revision requests
• Changes to the original scope
• Delayed payments
• Technical problems
• Third-party services
• Events or circumstances outside Creative Lab’s reasonable control
If a client becomes unresponsive for an extended period, Creative Lab may place the project on hold until communication resumes.
The number of revisions included in a package or project will depend on the specific service purchased.
A revision means a reasonable modification to the agreed design or deliverable. A completely new concept, substantially different direction, or change to the original project requirements may be treated as new work and may incur additional charges.
Clients should provide clear and consolidated feedback whenever possible.
Additional revisions beyond the agreed allowance may be charged separately.
Clients may provide logos, photographs, videos, fonts, text, artwork, music, trademarks, brand assets, or other materials for use in a project.
The client represents that they have the necessary rights, licenses, and permissions to use and provide such materials.
Creative Lab does not accept responsibility for claims arising from unauthorized or infringing materials supplied by the client.
Creative Lab may refuse to use content that it reasonably believes violates applicable laws, third-party rights, or our policies.
Unless otherwise agreed in writing, Creative Lab retains ownership of its original source files, working files, project files, templates, production methods, internal resources, and unused concepts.
Upon receipt of all applicable payments, the client will receive the agreed final deliverables and the usage rights specified for the project.
Ownership or licensing of a particular deliverable may vary depending on the service, package, third-party assets, fonts, stock materials, software licenses, or other applicable restrictions.
Where third-party materials are used, those materials remain subject to their respective licenses and terms.
Creative Lab does not automatically transfer ownership of editable source files unless source-file delivery is specifically included in the project agreement.
Unless otherwise agreed in writing, Creative Lab may display completed work in its portfolio, website, social media, promotional materials, presentations, or other marketing channels for the purpose of showcasing its services.
If a client requires a project to remain confidential or private, the client should notify Creative Lab before the project begins and obtain written confirmation of the agreed confidentiality arrangement.
For website development projects, the client is responsible for providing accurate content, business information, images, branding materials, product information, and other required assets unless content creation is included in the agreed scope.
Third-party hosting providers, domain registrars, plugins, themes, APIs, payment gateways, software, and other external services may be subject to their own terms and fees.
Creative Lab is not responsible for interruptions, changes, security incidents, pricing changes, compatibility issues, or failures caused by third-party services outside our control.
Unless maintenance or ongoing support is specifically included, completion of a website project does not automatically include unlimited future updates, maintenance, troubleshooting, hosting, or content changes.
For e-commerce projects, Creative Lab may assist with website design, development, product presentation, integrations, and related technical implementation.
The client remains responsible for the legality and accuracy of their products, pricing, descriptions, taxes, shipping information, payment arrangements, customer communications, and business operations.
Creative Lab does not guarantee sales, revenue, conversion rates, search rankings, advertising performance, or business results from an e-commerce website.
For video editing, animation, motion graphics, overlays, and related services, the client is responsible for providing source footage and other required assets unless otherwise agreed.
Final output specifications will be based on the project requirements agreed upon before production.
Changes requested after approval of a final version may require additional charges.
Creative Lab does not guarantee that third-party platforms such as YouTube, TikTok, Twitch, Instagram, or other services will accept, distribute, monetize, or promote delivered content.
Digital deliverables may be provided through email, cloud storage, file-sharing services, project-management platforms, or another agreed delivery method.
The client is responsible for downloading and securely storing delivered files.
Once a final deliverable has been approved by the client, subsequent changes may be treated as additional work.
If the client does not provide feedback within a reasonable period after receiving a deliverable, Creative Lab may consider the relevant stage of the project completed.
Because many Creative Lab services involve customized and time-intensive work, refunds may be limited once work has started.
Any refund, cancellation, or rescheduling will be handled according to the specific package, quotation, invoice, or agreement applicable to the project.
If a client cancels a project after Creative Lab has started work, Creative Lab may retain amounts corresponding to work already completed, resources already purchased, third-party costs, and other non-recoverable expenses.
If a project is cancelled because of client inactivity or failure to provide required information, the project may be considered paused or closed after reasonable notice.
Nothing in this section is intended to remove any rights that cannot legally be excluded under applicable law.
